These Terms and Conditions govern all supply of goods and services ("products") by Sweet Farewell Limited ("Sweet Farewell", "we", "us") to you, the purchaser, including your use of our website at sweetfarewell.co.nz ("the website").

By purchasing from us or using our website, you agree to these Terms and Conditions.

To make a purchase from our online shop, you must be 18 years of age or older. Purchases may only be made for personal use and not for resale. If you are purchasing on behalf of an organisation, you warrant that you are authorised to agree to these terms on its behalf.

We may update these Terms and Conditions at any time. Notice may be provided by posting updated terms on our website. Continued use of our website or services constitutes acceptance of the updated terms.

Failure to enforce any term does not constitute a waiver of our rights.

If any provision is found invalid or unenforceable, the remaining provisions remain in full force.

These Terms do not confer benefits on any third party unless expressly stated.

All prices are in New Zealand Dollars (NZD) and include GST, unless stated otherwise. Prices may change at any time. Delivery charges are additional and confirmed at checkout. An invoice will be emailed to the address you provide — you are responsible for ensuring your details are correct.

All orders are subject to product availability. If an item becomes unavailable, we will notify you as soon as possible.

We deliver only to New Zealand street addresses. We will use reasonable endeavours to dispatch orders promptly. Risk passes to you upon delivery to the supplied address.

Due to the handcrafted and memorial nature of our products:

• Colours, textures, and finishes may vary naturally.
• Sizes are approximate and may differ slightly between items.
• Jewellery and urns are delicate memorial items and should be handled with care.

We endeavour to ensure all information on our website is accurate, but errors or omissions may occur. We reserve the right to correct pricing or product errors and cancel orders where necessary.

Under the Consumer Guarantees Act (CGA) and Fair Trading Act, customers are entitled to a remedy if a product is faulty or not as described, damaged before delivery, or misrepresented in advertising.

However, due to the personal and memorial nature of our products, returns are not accepted once an urn or jewellery piece has been used or filled.

We will gladly replace or refund any item that arrives damaged or defective before use. Please contact us within 7 days of delivery if there is an issue.

Where goods or services are acquired for business purposes, the CGA does not apply. To the fullest extent permitted by law:

• We exclude all liability except in cases of bad faith.
• This exclusion applies to our employees, contractors, and agents.
• Our maximum liability is limited to the value of the faulty product or service supplied.

All content on our website — including images, branding, text, and design — is the property of Sweet Farewell Limited. You may not copy, reproduce, or distribute any content without written permission.

An order becomes binding once payment is received and a confirmation email is issued. We reserve the right to decline or cancel orders at our discretion.

We are not liable for delays or failure to supply due to events beyond our control, including natural disasters, courier disruptions, illness, or supply chain issues.

If incorrect information is supplied and we incur costs as a result, we may recover those costs from you (including legal costs on a solicitor-client basis).

We collect personal information to provide products and services, administer orders and payments, and communicate with you (if you opt in).

You may opt out of marketing communications at any time. Order-related messages will still be sent.

These Terms are governed by the laws of New Zealand. The Courts of New Zealand have non-exclusive jurisdiction over any disputes.
